All services provided by AlphaVPS may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any European Union law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless AlphaVPS from any claims resulting from the use of service which damages the subscriber or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to AlphaVPS's servers, or any other server on the Internet. Links to such materials are also prohibited.

The following are strictly prohibited uses and may result in immediate suspension and/or termination if discovered on Your account:

Minecraft and its variations and anything related to Minecraft including control panels or websites about Minecraft. (Yes, we mean it. We will not make any exceptions.)
Multics
Chobots, Starbound, Runescape
Teamspeak and Mumble
Denial of Service (DoS) attacks
Port scanning
TOR/VPN/Proxy/Any kind of anonmity services (VPN and Proxy usage is fine if they are only used by the customer themselves.)
Torrents
Illegal downloads/Piracy
CamFrog
Virtual currency (*coin) mining
HentaiAtHome
IP spoofing
Fake/Replica product websites
World Community Grid
HYIP websites
Booter/Stresser websites
HitLeap or any artificial traffic creation
iBusinessPromoter or similar software
LIULIANGKUANG
Chinese private game servers or websites
Nested Virtualization
Anything related to ZenCash
Any kind of high CPU, IO and network usage

NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITH OR WITHOUT NOTICE. ADDITIONALLY, AlphaVPS MAY NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS. That being said - AlphaVPS's team would not scan manually through the end user's files, unless a valid abuse report is received, a court order is received or local authorities request this to be done.

Traffic Usage

All account plans come with a predetermined monthly amount of traffic allowance. We charge $0.10 per GB over the allowance and offer multiple upgrade options if you decide to upgrade to a higher bandwidth plan, prior the end of your billing term. Services might be suspended by our team, to avoid huge overusage charges to be billed.

IRC

We allow IRC to be hosted on our servers, as long as it is used for lawful purposes.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of AlphaVPS is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund. All services must be used for lawful purposes only.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Billing

By the Account Activation Date of each month, AlphaVPS shall:

Deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to AlphaVPS by no later than the specified payment due date. AlphaVPS shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice on a monthly / quarterly / semi-annual or annual basis, 14 days prior the actual due date, unless otherwise specified. Payment delays should be explained via a ticket, to avoid service suspend/terminate.

Money back guarantee & refund policy

We do offer a 72 hours refund policy on the FIRST order for the specific account.

We do not refund cancelled services. For example, if your service is quarterly and you request a refund after two months, no refunds will be given. No refunds are issued for setup charges, add-on charges, domain-registrations, add-on purchases, SSL certificates or overage charges. In case of AUP violations, any and all refunds are forfeit.

Account Deactivations

Any account deactivated due to non-payment will require all invoices to be paid in full before using our services again.

Cancellation Refunds

We DO NOT refund partial monthly fees to accounts. We require 14 days notice for a cancellation.

Limitation of Liability

AlphaVPS shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from AlphaVPS's servers going off-line or being unavailable for any reason whatsoever. Furthermore, AlphaVPS shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of AlphaVPS's servers. All damages shall be limited to the amount paid for the current term of service. AlphaVPS shall not be responsible for any damages, claimed due a mis-use of their servers by end clients.

Violations

Violations of these Acceptable Use Policies should be referred to support@dagroup.bg. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Disclaimer

AlphaVPS cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain equipment, routing, software and programming used by AlphaVPS are not directly owned or written by AlphaVPS. Moreover, AlphaVPS holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as AlphaVPS sees fit.

Account Registration

By registering your account with AlphaVPS, you agree to the above policies and disclaimer. Upon registration of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.

Server Uptime Guarantee

AlphaVPS guarantees 99% service uptime on all hosting plans and VPS plans. Should we fail to deliver this for any given calendar month, your account will be refunded a pro-rated amount for the duration of excessive downtime.

Backups and data loss

AlphaVPS is in no way responsible for any data loss, which can be caused by various reasons, including but not limited to: Server hardware failure, user container beeing hacked. However we do take complimentary backups of our servers on our own good will.

AlphaVPS reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.

Privacy

AlphaVPS has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses the information gathering and dissemination practices for this Web site.

Information Automatically Logged

We use your IP address to help diagnose problems with our server and to administer our web site. We use this information for no other reason.

Order Forms

Our site uses an order form for customers to request services. All our order forms use encryption (SSL encryption). We collect sensitive information which is used only for our purposes, third party does not receive any type of information from us.

Contact information from the order forms is used to get in touch with the customer when necessary.

Billing information that is collected is used to bill the user for services.

Overview

DA International Group Ltd. (We, AlphaVPS) strongly believes that it's important to be as transparent as possible, regarding how we collect, process, store, share and use the personal information we gather through our website, web services and all other matters. We also believe that our subscribers and users should clearly understand how we handle their data. This privacy policy will outline all of the above and does not apply to information collected by third-party websites. Same policy will be updated periodically.

As a company, based in the EU, AlphaVPS is commited in being fully compliant with the General Data Protection Regulation (GDPR). GDPR is an European privacy law, which is into effect as of 25th May 2018. It will replace EU Data Protection Directive and will become the single data protection law through the whole EU and it's members.

Information we collect automatically

Users who sign up for our services, will be required to provide their real name, address, country, post code, telephone number, company name (where aplicable), VAT/TAX ID (where aplicable) and email address.

Users, who complete different subscription / marketing opt-in forms will be prompted to provide their email address

Users, who fill out different forms on our website will be required to provide email and name.

Information we gather through other sources

If we deem appropriate or otherwise needed, we may source additional information from Fraud and high risk scoring web services, namely - Maxmind and FraudRecord.

AlphaVPS uses a couple of different kind of cookies - functional cookies, analytics and statistics cookies, advertising cookies and 'other kind' of cookies. The functional cookies are required for our website to function properly and as intended and at the same time - make the user experience better. Analytics and statistics cookies are cookies from web services such as Google Analytics, which help us analyze the performance of our marketing and remarketing campaigns, as well as the user behavior on our website. Advertising cookies are used in our advertising campaigns, such as remarketing tags and similar use cases.

Payment Data Processing

AlphaVPS Utilizes 3 different payment gateways:

PayPal - When a transaction request is made, AlphaVPS passes the information to PayPal, the user gets redirected to PayPal's website and the transaction is made on PayPal's website. No identifying payment information is stored on AlphaVPS's servers.

BrainTreePayments (by PayPal) - When a transaction is made, AlphaVPS passes the information to BrainTreePayments. Our servers store only a special token, issued by BrainTreePayments, for the sole purpose of processing future payments automatically. The said token does not contain any kind of identifying payment data.

BitPay - For processing BitCoin payments. When a transaction request is made, AlphaVPS passes the information to BitPay, the user gets redirected to BitPay's website and the transaction is made on their website. No identifying payment information is stored on AlphaVPS's servers.

Considering no payment data is stored on AlphaVPS's (DA International Group Ltd's) servers, we are not enforced by law to be PCI-DSS compliant. We do ensure that all of our payment processors are PCI-DSS compliant and fully fulfilling their obligations, required by law.

How we use your personal data

All data processing handled by AlphaVPS is done for a specific reason or purpose. We do not process our user's data without justification in any case. In most of the cases, we process and use the personal information on the following basis:

For accounting purposes and records - AlphaVPS issues VAT invoices to all of our clients. We are required by law to fill them up with certain personal or company information.
For forming a contract - When our users sign up for our services, we enter in a Contract, requiring some personal information to be processed.
For providing the services, for which the specific user has signed up for
For providing pre-purchase or post-purchase support
For providing product-related support
For providing custom sales quotes or contracts
For marketing our upcomming services (If consent is given)
For sending news and information about upcomming events or upgrades

Disclosure of personal data

AlphaVPS will take all possible and reasonable measures to protect it's users' personal information safe from any unauthorized 3-rd party individuals or companies. We may share your personal information in various cases, including some of the following:

To cooperate with law enforcement
With our Contractors or Sub-Contractors, when needed to provide you with certain services and support.

In case of business acquisition

Retention of personal data

AlphaVPS will keep personal data for as long as it's required to fulfill the purpose for which it was collected - providing services, subscribing to our mailing list and others. We are required by law to keep paper copies of invoices issued to fulfill our accounting requirements, as well as tax requirements, for 10 years after the date of issue or 5 years after the date of completion of an external government audit.

Transfer of personal data

If by any reason, we need to transfer your personal data to other service provider, contractor or sub-contractor, as well as affiliate of AlphaVPS, we will ensure that it will be properly handled and receive the same level of protection, as if it remained with us and the new data processor will be fully GDPR compliant as we are.

Children

AlphaVPS's services are not suitable, neither designed to be used by children under the age of 18 years. Our services are strictly forbidden for such persons and We do not knowingly collect, store or share any personal information, belonging to children under 18 years. If you are under the age of 18 and provided AlphaVPS with your personal information, please ask your parent or guardian to contact us immediately, so we can delete all related data.

Marketing emails and campaigns

AlphaVPS may send marketing emails to users, who are in our opt-in lists. Such emails may contain information, however, not limited to - future services, promotions and upcomming events, in which we will take part in.

Your Choices

You may unsubscribe at any time from all promotional emails from us. You may disable your cookies to ensure no data is being stored in them and later - processed.

Your Rights

You can easily modify, access, correct or update your account information via our customer panel
You can request deletion of your account and personal data, by sending a written ticket, requesting it.
You can opt-out of all marketing emails
You can withdraw your consent for us to process your personal data
You can inform a data protection authority, in case you believe your information was mis-handled
Data portability - you can request all your personal information to be provided to you in a machine-readable format
And all other means and rights, specified in the GDPR act.

Changes to our privacy policy

AlphaVPS reserves the right to change, revise, modify, update or amend this Privacy policy at any time and in any matter. You should periodically check for updates.

GDPR Data Processing Agreement

Customers, who require a DPA, may view and download our DPA after requesting a direct link via a ticket.

By agreeing to our Terms of Service on sign up, you automatically accept our DPA.
